Waterview Towers is a 27-story condominium with 132 residences at 400 North Flagler Drive in downtown West Palm Beach. It sits on the east side of Flagler Drive directly on the Intracoastal Waterway, with Palm Harbor Marina in front of it and the Flagler Memorial Bridge to Palm Beach just to the north. The building was completed in 1981.
Its appeal is straightforward: large two- and three-bedroom residences that look over a working yacht marina to Palm Beach and the ocean, a few blocks from Clematis Street. Its history is less straightforward. The condominium spent roughly a decade in litigation with the marina's operator over the marina, the neighboring parking lot and control of the association, and the 2023 settlement of that dispute now shapes what is being planned next door. This guide covers the building, its residences, that history and what a buyer should check.

Residences and sizes
MLS records show a small number of plans that trade again and again:
| Residence type | Interior sizes in MLS records (Oct 2026) |
|---|---|
| Two-bedroom, two-bath | About 1,797 sq ft |
| Three-bedroom | About 2,109 to 2,647 sq ft, most often about 2,251 sq ft |
| Penthouse three-bedroom | About 2,900 sq ft |
These figures cover residences that have recently sold or listed, not every plan in the building. Brokerage summaries describe layouts that run east to west, with main balconies facing the sunrise over the marina and Palm Beach and bedrooms facing the city and the sunset. One listing describes elevator halls that serve two residences each, which gives a semi-private arrival.
Condition is the main variable in price. Many residences have been renovated with impact windows and doors, new kitchens and baths and modern finishes, while others are close to original and priced as renovation projects. The sales table below shows the spread.
The building and its upgrades
Waterview Towers is a 1981 high-rise with an underground garage and a ground-level pool deck facing the marina. Its original developer and architect are not documented in the sources we reviewed. In early 2025, listings reported that the association had just completed a multi-year series of improvements: new elevators, a new fitness center, a new roof and impact glass in the lobby.
Images are drawn from MLS listing photography for the building.
Amenities and services
- Heated pool and sundeck on the ground level overlooking Palm Harbor Marina
- Fitness center, renovated as part of the recent improvements
- Lighted tennis and pickleball courts
- Private dog park, according to a brokerage summary
- 24-hour attended lobby and security, doormen and concierge
- Assigned underground parking and valet service
- Bike storage and on-site management
Listings say association fees include building insurance, cable and internet, water and sewer, security, parking and the manager; confirm the current list in the budget.
The building does not sell boat slips with residences. Palm Harbor Marina, in front of the tower, is run by a separate operator; ask the marina directly about dockage availability and rates.
Location: downtown on the marina
Waterview Towers sits just south of the Flagler Memorial Bridge, which crosses to Palm Beach near Royal Poinciana Plaza, the Palm Beach shopping center a listing describes as directly across the water. Clematis Street, downtown restaurants and the waterfront promenade are within a short walk to the south, and The Ben hotel and Elisabetta's restaurant sit across Flagler Drive from the parcel just south of the tower. The Kravis Center, Rosemary Square and Palm Beach International Airport are a short drive.

The marina dispute and the 2023 settlement
The building's relationship with the marina next door has been contentious, and buyers should understand it:
| Date | Event |
|---|---|
| 1970s | The City of West Palm Beach leases waterfront land for a 132-unit condominium tower and an adjacent marina, according to a Rabideau Klein legal summary |
| 1981 | Waterview Towers completed |
| 2009 | Palm Harbor Marina expanded for larger yachts by Leisure Resorts, a Chase Enterprises company |
| 2015 | Waterview Towers residents sue, arguing the city should not have allowed the expansion |
| 2017 | Florida's Fourth District Court of Appeal rules in a case between the association and the city, limiting the city's interest to the land beneath the footprint of four piers |
| February 2023 | The association announces that all litigation with Leisure Resorts has settled, with the cases dismissed with prejudice |
| January 2026 | Related Ross and Leisure Resorts disclose plans for a private club on the parking lot south of the tower |
The disputes covered the marina expansion, a proposed hotel on the 1.5-acre parking lot south of the building, and control of the condominium board, where Leisure Resorts, representing the commercial side of the condominium, had sought equal representation with residents. Under the 2023 settlement, as the association described it to owners, the board has five residential and four commercial representatives, and each residence receives a free membership in a yacht club to be built on the commercial parcel south of the building.
That parcel is now the subject of a new plan. In January 2026, The Palm Beach Post and The Real Deal reported that Related Ross and Leisure Resorts plan a four-story building on the city-owned parking lot next to the marina, with retail and two public restaurants on the lower floors and a members-only club with a rooftop pool, spa and fitness center above. The Real Deal reported that the building is capped at 75 feet under the 2023 settlement. As of October 2026 we have not seen a final approval. Ask the association how the settlement's membership benefit applies to the planned club and what construction would mean for parking and views from lower floors.
Prices, recent sales and carrying costs

| 1403, two-bedroom, updated | 1,797 sq ft | $2.1 million | About $1,169 | November 2025 |
| 903, two-bedroom | 1,797 sq ft | $2.75 million | About $1,530 | April 2026 |
| 1206, three-bedroom | 2,400 sq ft | $3.4 million | About $1,417 | June 2026 |
| 2201, three-bedroom | 2,647 sq ft | $4.2 million | About $1,587 | April 2026 |
| PH C6, renovated penthouse | 2,900 sq ft | $5.5 million | About $1,897 | February 2026 |
Active listings, October 2026: two three-bedroom residences of about 2,251 sq ft were for sale, one on the fifth floor at $2.15 million, with new impact windows and air conditioning, and one on the 17th floor at $5 million. Two more residences were listed for rent.
Association fees: both active listings show $2,415 a month for a 2,251-square-foot residence, about $1.07 per square foot per month. One of the two listings flags a special assessment; ask for the amount, purpose and schedule.

| The Plaza of the Palm Beaches | 525 S Flagler Dr | 1985 | About 220 | Twin 32-story towers, downtown waterfront |

Waterview Towers and The Plaza are the two established full-service towers on the downtown waterfront. In 2026 MLS sales, renovated Waterview residences and renovated Plaza residences traded at broadly similar prices per square foot, but Waterview's monthly fees per square foot were lower and its marina setting is unique. The new towers to the north offer new construction and current building codes at higher entry prices and with waits for delivery. Our guides to The Ritz-Carlton Residences, West Palm Beach and Shorecrest cover those projects.
What to check before you buy
- Milestone inspection and SIRS. At 45 years old, the building is past the age at which Florida requires a milestone inspection. Request the milestone inspection reports, the structural integrity reserve study and the reserve funding plan. Our milestone inspection and SIRS guide explains what to look for.
- Special assessments. Ask for any adopted or proposed assessment, its purpose and who pays it at closing.
- The settlement and the club. Request the 2023 settlement terms as they affect owners, the status of the planned club on the parcel to the south and any remaining litigation.
- Governance. Understand how the residential and commercial members share the board, costs and decisions.
- Lease and pet rules. One brokerage summary reports a minimum lease of three months, one lease a year and no leasing in the first three years of ownership, plus a two-pet, 25-pound limit; current MLS rental listings show one lease a year with longer minimums. The condominium documents control, so confirm them before you rely on a rental plan.
- Insurance and condition. Get an HO-6 quote and check the age of the residence's windows, doors and air conditioning.
